Kentucky Declares Constitution Party a Hate Group

Corrupt Kentucky the first in the heart of corrupt politicians has accomplished a first in the history of politics. They have formally declared a recognized political Party that had a candidate for president on the ballot last year a Hate GROUP. No it wasn’t the Republican Party or the Democratic Party it was the Constitution Party. This party has long been known for its support of the constitution, rule of law, and the original intent of the founding fathers that created the documents that put into writing the rules of our nation. The basic premise is to assure our constitution freedoms and liberties are not infringed on, and our government, a creature of We the People that has been turned over by We the People to our elected representatives, complies with the written documents and laws that establish how the government is to be run.

Changes in the way the government is formulated or run can only be approved by We the People.

For the First time in the history of the USA except when the forefathers first declared their independence from tyrannical English rule, a political party is designated as a hate group by the government. The same government that political group works to assure complies with the law and constitution. That irony can not be found in a free republic. It is only found in tyrannical governments.

A free Republic demands a constant vigil by citizens to assure there is no loss of freedom.

Our state and local elected leaders, routinely act without having all of the facts and, assign police officers to unconstitutional duties protecting, aiding and abetting illegal aliens while violating the rights of citizens as defined not only in federal law but now in state law..

Sworn elected state and local officials and police officers regularly refuse to represent "We the People" and instead pander to special interest groups and participate in a host of other illegal activities that violate their sworn oaths of office.

The level of corruption has become so common place in Kentucky that a lack of it is perceived as an oddity. The greatest outrage can not be established by past behavior; only the future will define what lengths these corrupt politicians will go to for personal gain at the expense of We the People and the very constitution that guides our government we have defined.

However, there is one thing that borders on the treasonous and if not the politically obscene. They have declared the Constitution Party in Kentucky a Hate Group under the definition of the Kentucky Revised Statutes as adopted by the state legislature.

Corrupt Kentucky state and local politicians have incorporated into Kentucky state law, the same federal legislation that prohibits discrimination on the basis of race in a conspiracy against our individual rights. These are the same laws in the same words they have refused to enforce for years now.

Corrupt government officials have illegally granted and promoted use of state and local jurisdictions as a sanctuary for illegal aliens. Illegal aliens have settled in our city and state with the promise and delivery of government benefits without first establishing eligibility for the benefits many of which are subsidized by federal money. This conspiracy to distribute government funds and assets without determining the legality of the distribution in violation of federal law is a felony as defined by federal law. However the laws are ignored when illegals and government officials violate the law.

Unconstitutional orders, regulations local and state laws have prohibited government agents and employees from determining eligibility of beneficiaries to government resources based on race and nationality as a sole consideration. No questions are permitted if the person requesting benefits appears to be a Hispanic as established by their inability to speak English and their skin color.

Now these same corrupt institutions have leveled charges of hate law violations and specifically named a citizen group that supports the constitution; a violator of federal and now state hate laws. This unprecedented unconstitutional government act designed to malign and intimidate citizen voters is by definition an attempt to disenfranchise voters who are not Hispanic or illegal aliens. It is further an attempt to stifle freedom of speech and freedom to petition our government for redress of grievances. This unconstitutional act puts those they have charged as a hate group in immediate danger of severe bodily harm and death. They have put a target on our backs for illegal alien gang members to attack us.

This same target permits the media an opportunity to further defame and disparage the character of those citizens who only want to exercise constitutional freedoms guaranteed them.

The PDF is paid for with taxpayer funds and is provided by the Justice and Safety Center at Eastern Kentucky University on behalf of the Kentucky Justice and Public Safety Cabinet. That document states in the forward they:

“are pleased to publish our fifth report on the scope of hate crime and hate incidents in the Commonwealth of Kentucky. The Kentucky Justice and Public Safety Cabinet is charged in KRS 15A.040 with disseminating information on criminal justice issues and crime trends. This report reflects the Cabinet’s effort to provide state officials with a collection of statewide hate crime data in order to document the scope of this type of crime across Kentucky and the nation."

Specific statutes listed by the Justice and Safety Center at Eastern Kentucky University include the following which are copies of federal laws that have been on the books and unenforced by state and local law enforcement for some time. We the People have repeatedly asked and pleaded local and state legislators to enforce these laws but they refused saying they had no authority to do so even though the laws are clear in establishing that authority for state and local police departments.

"18 U.S.C. § 241 Conspiracy against rights:

If two or more persons conspire to injure, oppress, threaten, or intimidate any person in any State, Territory, Commonwealth, Possession, or District in the free exercise or enjoyment of any right or privilege secured to him by the Constitution or laws of the United States, or because of his having so exercised the same; or If two or more persons go in disguise on the highway, or on the premises of another, with intent to prevent or hinder his free exercise or enjoyment of any right or privilege so secured– They shall be fined under this title or imprisoned not more than ten years, or both; and if death results from the acts committed in violation of this section or if such acts include kidnapping or Hate Crime and Hate Incidents in the Commonwealth______________ an attempt to kidnap, aggravated sexual abuse or an attempt to commit aggravated sexual abuse, or an attempt to kill, they shall be fined under this title or imprisoned for any term of years or for life, or both, or may be sentenced to death.

18 U.S.C. § 242 Deprivation of rights under color of law :

"Whoever, under color of any law, statute, ordinance, regulation, or custom, willfully subjects any person in any State, Territory, Commonwealth, Possession, or District to the deprivation of any rights, privileges, or immunities secured or protected by the Constitution or laws of the United States, or to different punishments, pains, or penalties, on account of such person being an alien, or by reason of his color, or race, than are prescribed for the punishment of citizens, shall be fined under this title or imprisoned not more than one year, or both; and if bodily injury results from the acts committed in violation of this section or if such acts include the use, attempted use, or threatened use of a dangerous weapon, explosives, or fire, shall be fined under this title or imprisoned not more than ten years, or both; and if death results from the acts committed in violation of this section or if such acts include kidnapping or an attempt to kidnap, aggravated sexual abuse, or an attempt to commit aggravated sexual abuse, or an attempt to kill, shall be fined under this title, or imprisoned for any term of years or for life, or both, or may be sentenced to death."

State and local officials routinely violate these federal laws by providing deprivation of citizen rights privileges and immunities secured by the Constitution or laws of the United States. They have also provided different punishments, pains or penalties on account of such person being an alien. They have openly reduced penalties for illegal aliens so their families will not be disrupted (quote from local county attorney). Felony charges are routinely reduced to misdemeanors and illegals were permitted immediate release without penalty.

Aliens are not subjected to the same penalties as citizens and we the citizens are deprived of our rights. They are given benefits that violate the law, also violating our rights. Where are the federal prosecutors to end this? Many people have died because state and local officials refuse to enforce the same laws against illegals that they readily enforce against citizens. The following federal law specifically defines local and state police responsibility to enforce the law.

18 U.S.C. § 245. Federally protected activities:

Nothing in this section shall be construed as indicating an intent on the part of Congress to prevent any State, any possession or Commonwealth of the United States, or the District of Columbia, from exercising jurisdiction over any offense over which it would have jurisdiction in the absence of this section, nor shall anything in this section be construed as depriving State and local law enforcement authorities of responsibility for prosecuting acts that may be violations of this section and that are violations of State and local law."

The law further establishes that no one can interfere with federally protected activities. The Southern Law Poverty Center and local and state Kentucky officials, along with the Marxist Media attempted to deprive citizens of their constitutionally guaranteed rights of free speech and their rights to petition their government. Corrupt government officials and members of the media, as individuals and as a group, have: intimidated, maligned, defamed and otherwise attempted to prevent efforts of “We the People” to freely state grievances and seek redress of grievances and to vote for representatives in the Constitutional Party. They have now illegally declared the Constitutional party a “hate group.”

The law further clarifies what constitutes violation of the law and reprehensible acts like maliciously labeling peaceful citizen protesters as “members of the KKK”, “racists”, “haters” and other demeaning intimidating accusations.

The laws expressed in the referenced PDF and now laws adopted by KRS demand they can be enforced by state and local police officials.

It is time the Southern Law Poverty Center, state and local governments, state and local police departments, and national, state and local media is held accountable by the law for their unfounded charges of hate groups. They intentionally incite gangs of illegal aliens to attack USA citizens while the citizens exercise freedoms of assembly and free speech.

Specifically the unfounded SPLC terror group data used by the state to promote intimidation and character assassination must be stopped before violence and blood shed of citizens’ results more frequently or other citizens are forced by intimidation to be deprived of their constitutionally guaranteed freedoms. Equal application of the law is a must. .

“(4) any person because he is or has been, or in order to intimidate such person or any other person or any class of persons from—(A) participating, without discrimination on account of race, color, religion or national origin, in any of the benefits or activities described in subparagraphs (1)(A) through (1)(E) or subparagraphs (2)(A) through (2)(F); or (B) affording another person or class of persons opportunity or protection to so participate; or

(5) any citizen because he is or has been, or in order to intimidate such citizen or any other citizen from lawfully aiding or encouraging other persons to participate, without discrimination on account of race, color, religion or national origin, in any of the benefits or activities described in subparagraphs (1)(A) through (1)(E) or subparagraphs (2)(A) through (2)(F), or participating lawfully in speech or peaceful assembly opposing any denial of the opportunity to so participate–shall be fined under this title, or imprisoned not more than one year, or both; and if bodily injury results from the acts committed in violation of this section or if such acts include the use, attempted use, or threatened use of a dangerous weapon, explosives, or fire shall be fined under this title, or imprisoned not more than ten years, or both; and if death results from the acts committed in violation of this section or if such acts include kidnapping or an attempt to kidnap, aggravated sexual abuse or an attempt to commit aggravated sexual abuse, or an attempt to kill, shall be fined under this title or imprisoned for any term of years or for life, or both, or may be sentenced to death.

As used in this section, the term “participating lawfully in speech or peaceful assembly'' shall not mean the aiding, abetting, or inciting of other persons to riot or to commit any act of physical violence upon any individual or against any real or personal property in furtherance of a riot. Nothing in subparagraph (2)(F) or (4)(A) of this subsection shall apply to the proprietor of any establishment which provides lodging to transient guests, or to any employee acting on behalf of such proprietor, with respect to the enjoyment of the goods, services, facilities, privileges, advantages, or accommodations of such establishment if such establishment is located within a building which contains not more than five rooms for rent or hire and which is actually occupied by the proprietor as his residence."

The law again reinforces the federal direction for all local and state law enforcement officers to enforce the law. They have never had the option of refusing to enforce these provisions with the defense they have n authority. The law has always been clear on this issue. Intimidation includes the fear of imminent harm or death. "(c) Nothing in this section shall be construed so as to deter any law enforcement officer from lawfully carrying out the duties of his office; and no law enforcement officer shall be considered to be in violation of this section for lawfully carrying out the duties of his office or lawfully enforcing ordinances and laws of the United States, the District of Columbia, any of the several States, or any political subdivision of a State. For purposes of the preceding sentence, the term “law enforcement officer” means any officer of the United States, the District of Columbia, a State, or political subdivision of a State, who is empowered by law to conduct investigations of, or make arrests because of, offenses against the United States, the District of Columbia, a State, or a political subdivision of a State. (d) For purposes of this section, the term “State” includes a State of the United States, the District of Columbia, and any commonwealth, territory, or possession of the United States."

The relief, rules of construction, remedies and definitions clearly establish rights of citizens to assemble and seek redress of grievances under their guaranteed constitutional freedoms.

(B) Relief.–In any action under subparagraph (A), the court may award appropriate relief, including temporary, preliminary or permanent injunctive relief, compensatory damages, and civil penalties as described in paragraph (2)(B).

d) Rules of Construction.–Nothing in this section shall be construed—

(1) to prohibit any expressive conduct (including peaceful picketing or other peaceful demonstration) protected from legal prohibition by the First Amendment to the Constitution;

(2) to create new remedies for interference with activities protected by the free speech or free exercise clauses of the First Amendment to the Constitution, occurring outside a facility, regardless of the point of view expressed, or to limit any existing legal remedies for such interference;

(3) to provide exclusive criminal penalties or civil remedies with respect to the conduct prohibited by this section, or to preempt State or local laws that may provide such penalties or remedies; or

(4) to interfere with the enforcement of State or local laws regulating the performance of abortions or other reproductive health services.

e) Definitions.–As used in this section:

(1) Facility.–The term “facility” includes a hospital, clinic, physician's office, or other facility that provides reproductive health services, and includes the building or structure in which the facility is located.

(2) Interfere with.–The term “interfere with” means to restrict a person's freedom of movement.

(3) Intimidate.–The term “intimidate” means to place a person in reasonable apprehension of bodily harm to him- or herself or to another.

(4) Physical obstruction.–The term “physical obstruction” means rendering impassable ingress to or egress from a facility that provides reproductive health services or to or from a place of religious worship, or rendering passage to or from such a facility or place of religious worship unreasonably difficult or hazardous.

Page 25 Table 6.4 defines the Constitution Party of Kentucky as a hate group based on a designation presented by the Marxist, Southern Poverty Law Center. The state of Kentucky is using this bigoted anti American SPLC recommendation to designate a citizen group of patriots as a hate group.

Good Job SPLC, may you and your ilk face the long arm of the law. You have created an atmosphere of hate and an environment of fear to achieve your goals of destroying our constitutional rights to vote, and free speech. It is long past time your reign of terror comes to an end. A free and peaceful nation can not exist with public hate groups that have the ear of our elected representatives who readily print your biased undocumented unfounded reporting.

The very fact this malicious vitriol is published with state funds contributes to the level of malice and hatred fomented against citizen protesters. Our corrupt elected leaders and police departments refuse their constitutional and sworn duty to defend the constitution against all who would destroy it foreign or domestic and now they are participants in an conspiracy to deprive protesting citizens of constitutional rights.

Corrupt government officials also fail to honor their sworn oath of duty by refusal to enforce valid laws and regulations enacted to assure there is no infringement of constitutionally protected freedoms.
